Privacy Policy
A. Lead Generation Data and Restrictions. "Lead Generation Data” means the information a Meta user elects to send to us through a Lead Generation Feature, which may consist of such Meta user’s name and email address, and any additional user information. We ensure that no Lead Generation Features will be targeted to any minors. We will not collect any data that is sensitive or prohibited by Meta's Advertising Standards available at https://transparency.meta.com/policies/ad-standards/.
B. We will ensure that each Lead Generation Feature includes all disclosures and choice mechanisms necessary and sufficient to comply with applicable laws, rules and regulations, including any necessary offer terms promoted in the Lead Generation Feature (e.g., criteria to qualify, expiration date, or limitations on redemption) (“Offer Terms”).
C. Compliance Requirements. We may only use the Lead Generation Data in accordance with applicable laws, rules and regulations, including all applicable data privacy, advertising, telemarketing or other laws. Regardless of how we obtain content and information from users, we are responsible for securing all necessary permissions and providing all disclosures and choice mechanisms necessary and sufficient to use the Lead Generation Data. On our Facebook page or profile, or our Instagram account, we provide a mechanism for users to contact us and we agree to respond to any requests by users for more information about our use of the Lead Generation Data.
D. Limitations on Use of Lead Generation Data. We may only use the Lead Generation Data in accordance with these terms. If we use the Lead Generation Data for any purpose other than to provide the service associated with the call-to-action in the Lead Generation Feature, we are responsible for obtaining consent as necessary from the Meta user. We must comply with any necessary Offer Terms promoted in the Lead Generation Feature and any consents or additional terms and conditions agreed to by the Meta user (including any privacy policy we link to) when agreeing to provide Lead Generation Data.
E. Do Not Sell; Affiliate and Agency Use. We may not sell Lead Generation Data under any circumstances. We may only transfer Lead Generation Data as permitted by this section. Lead Generation Data may be transferred if the recipient only uses the Lead Generation Data to fulfill the purpose for which it was collected (as described by a reasonably prominent notice and agreed to by the Meta user at the point of collection). In the event we share Lead Generation Data with a third party, we do so solely at our own risk and we will ensure that any such third party complies with these terms and all applicable laws, rules and regulations. If we are receiving Lead Generation Data on behalf of an advertiser, we may only use or share such Lead Generation Data on such advertiser’s behalf and we may not augment, commingle, or supplement such Lead Generation Data with any other data from any other advertiser.
F. Security. We will have in place appropriate technical and organizational measures to protect Lead Generation Data against unauthorized or unlawful processing and against accidental loss, destruction or damage, and which provides a level of security appropriate to the risk represented by the processing and the nature of the data to be protected. Lead Generation Data may be made available to us through protocols specified by Meta (including Meta APIs), and our use of such protocols must comply with Meta’s Platform Terms.
G. Modification and Termination. Meta may modify, suspend or terminate access to, or discontinue the availability of, the Lead Generation Feature at any time. We may discontinue our use of the Lead Generation Feature at any time.
These terms govern our use of the Lead Generation Features. They do not replace any terms applicable to our purchase of advertising inventory from Meta (including but not limited to the Meta Advertising Standards), and such terms will continue to apply. Lead Generation Features are subject to the Meta Commercial Terms located at https://www.facebook.com/legal/commercial_terms, and are part of “Meta” under the Meta Terms of Service (https://www.facebook.com/legal/terms), which includes the Self-Serve Ads Terms located at https://www.facebook.com/legal/self_service_ads_terms, the Meta Advertising Standards located at https://transparency.meta.com/policies/ad-standards/, the Meta Platform Terms located at https://developers.facebook.com/terms/, and the Pages, Groups and Events Policies located at https://www.facebook.com/policies_center/pages_groups_events. Our use of the Lead Generation Features is deemed part of our use of, and actions on, “Meta.” In the event of any express conflict between these terms and the Meta Terms of Service or, as applicable, the Instagram Terms of Use, these terms will govern solely with respect to our use of the Lead Generation Features and solely to the extent of the conflict. Meta reserves the right to monitor or audit our compliance with these terms and to update these terms from time to time, and our continued use of this feature constitutes acceptance of those changes.
